About marasem

This service is operated by marasem albayanat Company. Registered business address: RFFA3548.

Our website is marasem.sa. You can contact us through the website's Contact Us page. In these Terms, ‘marasem’, ‘we’, and ‘us’ mean the company, and ‘you’ means the customer or website user.

marasem is the seller of orders placed with us. We may use printing partners, payment providers, and delivery companies to perform parts of the service, while remaining responsible for our obligations to you as seller.

2

Using the service and placing orders

Individuals and businesses may use the service. You must have the legal capacity to enter the relevant agreement. If you act for a business or another person, you must have authority to do so.

You may create designs and share them, including with another printer. Creating or sharing a design does not itself require a purchase from marasem. If you send your design to another printer and place an order directly with that printer, the printing agreement is between you and that printer alone. That printer is responsible for fulfilling your order, including print quality, delivery times, charges and handling refund requests. marasem is not a party to that agreement and is not responsible for that printer's acts or errors. This does not exclude responsibility for marasem's own acts and obligations, or for orders you place with marasem that our partners fulfil.

Before payment, you must be able to review your design, product specifications, quantity, delivery details, total price, and these Terms. By accepting these Terms and completing payment, you place your order and authorize us to begin order processing, including the review described in clause 3 and preparation for production. Physical printing is subject to that review and resolution of identified issues. Your order confirmation records the design version and specifications to be produced.

3

Design approval, printability review and cancellation

Approval is based on the on-screen design only. Where printed samples are offered, you may order one before the full order; a sample does not change the basis of approval or the agreed specifications. Before paying, check spelling, wording, images, image quality, layout, cup specifications, quantity, and all other order details.

We review every design submitted to us for printing, including each revised version, before physical printing begins. This is a technical review of suitability for printing, including file format, image resolution, dimensions, layout and compatibility with the intended cup and printing process. It is not a comprehensive proofreading, creative-design or legal-clearance service, and it does not guarantee that every issue will be detected.

If we identify a technical problem, a concern about the content or rights, or another issue affecting the order, we will contact you, explain the issue and hold the affected printing while it is addressed. We may withhold specific details only if the law prohibits us from sharing them. We may request corrected artwork, information or evidence of permissions, or discuss a workable alternative. We will obtain your approval before changing the appearance, wording or specifications of your approved design, and agree any resulting price change before proceeding.

Printability may also require confirmation by our printing partner. An initial review does not guarantee that the printer can produce the design as submitted. If our printing partner later reports that it cannot print the design or meet the agreed specifications, we will pause the affected work, contact you and seek a workable resolution. We will not knowingly proceed with a technically unsuitable design without resolving the issue and obtaining any required approval from you.

We may refuse or cancel an order, or an affected part, if the approved design cannot reasonably be printed, necessary corrections or permissions cannot be obtained, or there are reasonable grounds to consider the material unlawful, offensive, defamatory or infringing. We will notify you of the decision. We will explain the reason unless the law prohibits us from sharing it. We will not proceed with printing material we know to be unlawful or infringing. If we cancel the entire order under this clause, we will refund all amounts you paid for it, including delivery charges. For cancellation of an affected part only, we will refund the payments attributable to that part and any associated charges for services not provided, without limiting any wider refund or other right required by law. Refunds are processed using the method and timing described in clause 9.

If corrected artwork or additional information is needed, we will explain its effect on timing. Review or a printer's rejection does not automatically restart the full delivery period or allow an indefinite extension. The delay-notification and customer rights in clause 7 continue to apply.

You remain responsible for the content you supply and approve as set out in clause 10. Payment, review, acceptance or printing by marasem does not transfer that responsibility to us. Your approval does not excuse mistakes introduced by marasem or a failure to meet the agreed specifications, and clause 14 continues to apply.

4

Colours and screen previews

Colours in the design tool and on-screen previews are visual guides, not colour-accurate proofs. Screen settings, lighting, inks, cup materials, and printing processes may affect how colours appear.

We do not guarantee an exact match between screen colours and printed colours. Minor, reasonable colour variations inherent in printing do not, by themselves, constitute a defect or create a right to a refund or replacement, provided the products otherwise conform to the agreed specifications.

Any specific colour-matching requirement must be expressly accepted by marasem in writing before the order is placed. This clause does not excuse material printing errors, failure to meet an expressly agreed requirement, or a breach of mandatory product-quality or safety obligations.

5

Prices and payment

Cup prices range from SAR 0.47 to SAR 1.50 per cup, rounded for display. The exact unit price for your order, any monetary rounding and the final total are shown before payment. Delivery charges and any other applicable charges are shown separately.

Prices displayed to customers are the amounts payable. Before you confirm and pay, checkout will show a breakdown of product charges, delivery charges and any other applicable charges, together with the currency and total amount payable. The stated cup-price range is not the total delivered-order price.

Payment must be made using a payment method available at checkout. Available methods may change from time to time. Order processing begins only after successful payment; physical printing is subject to clause 3.

We will provide an order confirmation and an invoice, showing the relevant charges and delivery information. A later change to website prices does not, by itself, change the price of an order already placed.

6

Returns, cancellations and changes

Your cups are made to your approved specifications, and order processing, including artwork review and preparation for production, begins immediately after payment. Physical printing is subject to clause 3. We do not accept returns, replacement requests or cancellations solely because you change your mind where the custom-made cups are free from defects and match the approved design and agreed specifications. This does not affect the defect and nonconformity remedies in clause 9 or the other legal rights preserved below. Changes to artwork or order specifications after payment are not guaranteed.

You may contact us promptly through Contact Us to request a cancellation or change. We will consider whether it can be accommodated. A discretionary request does not itself stop production; any cancellation or change we accept will be confirmed in writing. We will disclose and obtain your agreement to any revised price before carrying out an agreed change.

These restrictions do not limit rights relating to defective or nonconforming products, qualifying delivery delays, or other mandatory legal remedies. They also do not limit any statutory right to correct an electronic-input error. Where the ordering system did not allow correction, notify us immediately on discovering the error and within 24 hours of sending the relevant electronic communication; the statutory right applies subject to its legal conditions, including that you have not benefited from the relevant product or service.

7

Production and delivery timing

We currently deliver only within Saudi Arabia. Our usual estimated arrival times at your delivery address, including production and delivery, are set out below. Working days are Sunday through Thursday, excluding official public holidays in Saudi Arabia.

Estimated arrival after payment
Order quantityEstimated arrival after payment
10,000 cups or fewer7 working days
More than 10,000 cups30 working days

The applicable category and delivery period will be displayed before payment and recorded with your order. Any different period known at checkout will be disclosed before you order. The order confirmation or invoice will state the expected delivery date and place.

These are estimates, not promises of an exact arrival day. Actual delivery may take longer because of artwork issues requiring your response, changes you approve, or circumstances affecting production or delivery. A separately agreed delivery commitment remains effective.

If we anticipate a delay or a difficulty materially affecting delivery, we will notify you promptly and provide updated timing. We will obtain your agreement to an extension where required by law. Corrections to artwork do not automatically restart the entire delivery period; we will explain the effect on your order.

Describing delivery times as estimates does not authorize indefinite delay or remove statutory rights. Where Saudi law entitles you to cancel for delay, you may exercise that right and obtain the payments and other amounts recoverable under the law. The custom-made nature of the cups does not, by itself, remove those rights. Any force-majeure exception applies only to the extent recognized by applicable law.

8

Delivery details and receipt

Provide accurate contact and delivery details and make reasonable arrangements to receive the order. Tell us promptly if you discover an error. We will explain whether a correction is still possible and any effect on delivery.

If incorrect information supplied by you or your unavailability causes a failed delivery, we will contact you about the next steps. Any reasonable additional redelivery charge attributable to that issue will be disclosed and agreed before redelivery. We will not impose such a charge for a delivery failure for which marasem or its delivery partner is responsible.

Please inspect the order on receipt where reasonably possible. A delivery receipt or signature does not waive rights concerning damage, shortages, hidden defects, or nonconformity. Follow the product's stated use and storage instructions.

9

Defects, replacement, returns and cancellation

You may request replacement, reprinting, or cancellation of the affected purchase and a refund if cups are defective, arrive damaged or incomplete, or do not match the approved design or agreed specifications. Examples include cups that leak during their intended use because of a defect, manufacturing faults, and significant printing errors such as wrong or missing artwork or a printed design that differs substantially from the approved design. These are examples, not an exhaustive list of defects or failures to meet agreed specifications.

Contact us through Contact Us as soon as reasonably possible after discovering the issue. Provide your order number, a description, and photographs, a video showing leakage, or other reasonable evidence where available. We may request reasonable further information or arrange inspection to assess the problem and the affected quantity. Our assessment does not prevent you from pursuing a legal remedy or referring the matter to a competent authority.

For a confirmed issue for which marasem is responsible, we will provide a remedy. Where applicable law permits us to choose, we may supply equivalent, defect-free cups matching the agreed specifications, including by reprinting, or cancel the affected purchase and refund the amount due. Where you have a legal right to cancellation, a refund, a price reduction, compensation or another remedy, we will honour that right. A request for a particular remedy does not remove any lawful right to provide equivalent defect-free replacements.

A change of preference, or a wording or artwork error you supplied and approved that we accurately reproduce, does not by itself make the cups defective. This does not excuse errors introduced by marasem, failure to meet agreed specifications, or responsibility preserved by clauses 3, 10 and 14. Minor, reasonable colour differences described in clause 4 do not alone justify a return, replacement or cancellation. Damage caused solely by misuse or improper storage after delivery is not a manufacturing defect; this does not exclude a defect present on delivery or caused by a condition that already existed before delivery.

We cover necessary return and replacement-delivery costs for an issue for which we are responsible. Where an order can reasonably and lawfully be divided, the remedy may concern only the affected cups. This does not restrict a right relating to the whole order, including where dividing it would cause harm or the order would not have been accepted without the defective part. Any cancellation and refund will include the amounts and associated charges required by law.

We will explain the remedy and its expected timing. Refunds will be processed through the original payment method where possible, or another lawful method agreed with you, without delay beyond applicable legal requirements. Payment-provider processing time does not remove our obligations. No short reporting deadline in our internal process extinguishes rights concerning hidden defects or other mandatory claims.

The restriction on change-of-mind returns does not remove legal rights arising from a qualifying delivery delay, non-delivery, product safety, or any other mandatory legal ground. Clauses 6, 7 and 14 continue to apply.

10

Responsibility for your content and permission to print

You retain the rights you hold in your designs. As between you and marasem, you are responsible for the wording, spelling, statements, logos, images, templates and other content you supply or instruct us to include, and for the accuracy, lawfulness and necessary permissions for that content. You confirm that you own or hold all rights and permissions needed for marasem and its printing partners to reproduce and print it for your order. Copyrighted material may be submitted only where the required permission or another lawful basis for the requested use exists. Do not submit unlawful, offensive or defamatory content, or material that infringes copyright, trademark, privacy, confidentiality or other rights.

You must check and approve your final content before payment and approve any subsequent changes before printing. Our technical review, contact about an issue, acceptance of payment, acceptance of an order or decision to print does not certify the content's accuracy or lawfulness, confirm ownership or permissions, or endorse its message. It does not replace your responsibility to obtain the required rights and permissions.

To the extent permitted by Saudi law, marasem is not liable to you for errors in, or loss caused solely by, content you supplied and approved where we accurately reproduce it within the permissions actually held for the order. This does not exclude responsibility for our own acts or omissions, unauthorized changes, use outside those permissions, or any liability preserved by clause 14. It does not restrict the rights of third-party rights holders or competent authorities.

To the extent permitted by law, you must reimburse marasem for reasonable, documented losses and costs directly caused by your breach of the content and permission obligations in this clause, including amounts legally payable to third parties. This does not cover loss caused by marasem's own breach, fault, unauthorized changes or use beyond your instructions or the scope of the uses agreed in these Terms, and it does not transfer penalties or liabilities that cannot lawfully be transferred. We will notify you of a relevant claim and give you a reasonable opportunity to provide information and respond. A settlement we make with a third party does not, by itself, establish an amount you owe unless you agree to it in writing or a competent court or authority determines your responsibility and the recoverable amount.

You grant marasem and its necessary service providers a non-exclusive, royalty-free permission to store, reproduce, display to you, prepare for printing, print, and otherwise process submitted material as needed to provide the design service and fulfil your order. This copyright permission applies worldwide for those purposes and lasts while we provide the requested service or fulfil your order, and afterwards only to the extent and for the period necessary for lawful record retention. Changes to the appearance of your approved design require your approval. This permission does not itself authorize a transfer of personal data abroad; retention and processing of personal data remain subject to the Privacy Policy and applicable law.

Permission to fulfil your own order is separate from showing a design in Explore under clause 11. We may request reasonable evidence of permissions and may restrict material while a rights complaint is assessed.

11

Showing a design in Explore

You can choose to show a design in Explore. Other visitors can only view it there; they may not copy, reuse or print it. You can remove it at any time, and we may remove any design from Explore.

12

Website use and website materials

Do not misuse the website, interfere with its security or operation, impersonate others, or use it for unlawful activity. If you have an account, keep its access details secure and notify us of suspected unauthorized use.

Rights in marasem's name, branding, website software, and other website materials remain with their respective owners. Permission to create or share a cup design does not grant ownership of the website or permission to copy unrelated website assets. Any supplied template or asset remains subject to its stated licence.

We may restrict access or content where reasonably necessary to address misuse, security, or legal requirements. Such action does not remove our obligations relating to paid orders, refunds, or other accrued rights.

13

Privacy

Our separate Privacy Policy explains the personal data we process, the purposes and legal bases, relevant disclosures to service providers, retention, and how you may exercise your rights. It is available through the website's Privacy Policy link.

Acceptance of these Terms is not blanket consent to unrelated marketing or publication of personal information. Where consent is the required basis, we will obtain it separately as required by law and provide a way to withdraw it. Copyright permissions do not override data-protection rights.

14

Responsibility and legal rights

marasem remains responsible for performing its obligations under the order and applicable law, including work performed on its behalf by printing and delivery partners. Customer responsibilities, approved specifications, and reasonable colour variations will be considered when assessing a complaint.

We are not a party to an order you place directly with another printing vendor and do not guarantee that vendor's production or delivery. This does not exclude responsibility for marasem's own acts or legal obligations.

Nothing in these Terms excludes liability for fraud, gross negligence, a wrongful act, or any liability or remedy that cannot lawfully be excluded. Nothing limits mandatory rights concerning product safety, defects, delivery, intellectual property, or personal data. Any limitation is effective only to the extent permitted by Saudi law.

15

Questions and complaints

Submit enquiries, complaints, and relevant requests through the Contact Us page at marasem.sa. For an order issue, include your order number and enough detail for us to investigate. We will review the request promptly, seek reasonable additional information if necessary, and communicate our response and material progress updates through the contact details you provide.

You do not have to give up any legal remedy to contact us. This process does not prevent you from approaching the Ministry of Commerce, another competent authority, or the competent courts, and does not impose a compulsory waiting period before exercising statutory rights.

16

Changes and applicable law

We may update these Terms for future use and orders by publishing the revised text and effective date. An update does not retrospectively change an existing order, expand an earlier content licence, or remove accrued rights without the agreement or other legal basis required by law.

These Terms and orders placed with marasem are governed by the laws of the Kingdom of Saudi Arabia. Disputes fall within the jurisdiction of the competent Saudi courts, without restricting access to competent regulators or mandatory consumer rights.

These Terms are provided in Arabic and English. If the versions differ, the Arabic text prevails to the extent permitted by law. If a provision is unenforceable, the remaining provisions continue to apply so far as legally possible.
